By accessing or using the Red Hot Monde magazine services, you are agreeing to be legally bound by and act in compliance with the terms of this Agreement. If you do not agree to the terms of this agreement, do not use or access the magazine services.

These terms of use and other policies that may apply to a specific feature of the magazine services which are operated or owned by Red Hot Monde (“RHMM”, “us”, “we”, or “our”), represent a contract in electronic format between you (“you”, “yourself”, “your”) and RHMM.

The Red Hot Mode Magazine content and services are for general entertainment, information, and discussion purposes. The term “Content” includes but without limitation, photographs, videos, written articles, posts, information, text, graphics, and other related media provided, or otherwise made available through the RHMM services.

Eligibility

The services provided by RHMM may not be suitable for children under the age of 13 and as such, are not intended for use or access by children. Please, do not access or make use of the RHMM service if you are under the age of 13.

Intellectual Property Rights and License

The Red Hot Monde Magazine services include contents that are obtained in whole or in part from materials or contents provided and owned by RHMM, RHMM Licensors, or third parties. As regards RHMM and you, we own and reserve all rights, interests, and titles in and to the copyrights, trademarks and service marks, and all other intellectual property rights associated with RHMM.

You agree that you will not in any way copy, download, reproduce, duplicate, distribute, archive, publish, modify, translate or sell the Magazine contents or services unless expressly approved by Red Hot Monde in writing.

You agree that you will not incorporate the Magazine content or services into any hardware or software application nor surround the Magazine content or services with any third party content, branding, or material.

You agree that your access and use of the magazine services and contents are for noncommercial and personal purposes only.

Permission is granted to temporarily download one copy of the materials (information or software) on RHMM’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license, you may not: modify or copy the materials; use the materials for any commercial purpose, or for any public display.

Intellectual Property Ownership and Original Images & Files

Unless negotiated and agreed in writing between you and RHMM, the copyrights of general photography works, illustration and articles organized by RHMM belong to RHMM.

When you provide images and other content to us, we do not claim ownership of your content. Instead, you only grant RHMM a non-exclusive, transferable, royalty-free, sub-licensable, worldwide license to use, distribute, copy, modify, display or create derivative works of your image(s) or other contents.

You also grant RHMM permission to use your image, name, and associated information in connection with our magazine services, adverts, and other sponsored contents without any compensation to you.

User Content

“User Content” refers to any and all content and information such as photos, video, audio, or other contents provided to us by you.

You agree that you are responsible for the user contents that you provide to us which may expose you to liability. You further agree that under no circumstances will Red Hot Monde be held liable for any defect or inaccuracy in any user content.

By submitting a User Content to RHMM, you hereby grant, represent and warrant that you have the right to grant, to RHMM a nonexclusive, irrevocable, royalty-free and fully-paid worldwide license to reproduce, incorporate in other works, distribute, publicly display and otherwise use your submitted content, and to grant sublicenses of the foregoing for all and any lawful purpose.

THE MAGAZINE SERVICES ARE PROVIDED “AS-IS” AND “AS AVAILABLE” AND WE (AND OUR SERVICE PROVIDERS) EXPRESSLY DISCLAIM ANY WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY, OR NON-INFRINGEMENT. WE (AND OUR SERVICE PROVIDERS) MAKE NO WARRANTY THAT THE MAGAZINE SERVICES: (A) WILL MEET YOUR REQUIREMENTS; (B) WILL BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE BASIS; OR (C) WILL BE ACCURATE, RELIABLE, FREE OF VIRUSES OR OTHER HARMFUL CODE, COMPLETE, LEGAL, OR SAFE.

Limitations of Liability

IN NO EVENT SHALL RHMM (AND OUR AFFILIATES AND OUR AND THEIR OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS ) OR OUR SERVICE PROVIDERS BE LIABLE TO YOU OR ANY THIRD PARTY UNDER CONTRACT, IN TORT, STRICT LIABILITY, NEGLIGENCE OR ANY OTHER LEGAL OR EQUITABLE THEORY, FOR ANY LOSS OR DAMAGES (INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, PUNITIVE, ACTUAL, CONSEQUENTIAL, INCIDENTAL, SPECIAL, EXEMPLARY, OR OTHERWISE) LOST PROFIT, DATA LOSS, COST OF PROCUREMENT OF SUBSTITUTE GOODS ARISING FROM OR RELATING TO THIS AGREEMENT OR YOUR USE OF, OR INABILITY TO USE, THE MAGAZINE SERVICES INCLUDING FOR ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE (REGARDLESS OF THE SOURCE OF ORIGINATION), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY DAMAGES ARISING FROM OR RELATED TO THIS AGREEMENT (FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION), WILL AT ALL TIMES BE LIMITED TO THE GREATER OF (A) FIFTY US DOLLARS ($50) OR (B) AMOUNTS YOU’VE PAID RHMM IN THE PRIOR 12 MONTHS (IF ANY). THE EXISTENCE OF MORE THAN ONE CLAIM WILL NOT ENLARGE THIS LIMIT. YOU AGREE THAT OUR SERVICE PROVIDERS WILL HAVE NO LIABILITY OF ANY KIND ARISING FROM OR RELATING TO THIS AGREEMENT.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OF CONSEQUENTIAL DAMAGES, SO IN THOSE STATES OUR LIABILITY IS LIMITED TO THE EXTENT PERMITTED BY LAW.

Red Hot Monde Magazine has not reviewed all of the sites linked to its web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply website endorsement by Red Hot Monde Magazine and the use of any such linked web site is at the user’s own risk.

Governing Law

Any claim relating to RHMM’s web site shall be governed by and construed solely in accordance with the laws of the State of California without regard to its conflict of law provisions in the application of the law of another jurisdiction.

This Agreement constitutes the whole agreement and understanding between you and RHMM as to its subject matter and there are no provisions, terms, conditions, or obligations, whether oral or written, express or implied, other than those contained or referred to in this Agreement.

We may revise and make changes to this Agreement from time to time so that they accurately reflect our services and polices. We will notify you by posting an updated version on the Magazine Services. You consent and agree to receive notices of updates to this Agreement through our posting of an updated Agreement on the Magazine Services. You should visit this page or section regularly to review the current version of the Agreement. Your continued use of the Magazine Services will be deemed as irrevocable acceptance of any revisions made.
